Aus gegebenem Anlass, möchte ich mich hier kurz zur Berichterstattung in den Medien äußern, demnach Whatsapp dem Nutzer alle Rechte an versendeten Bildern entzieht und diese für Werbung jeglicher Art verwenden darf.
Die Berichterstattung in den Medien ist schlechtweg falsch! Wer sich die AGBs von Whatsapp durchliest und der englischen Sprache mächtig ist, trifft auf folgende passage:
5. User Status Submissions
(ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the Status Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the Status Submissions in the manner contemplated by the Service and these Terms of Service. To be clear: you retain all of your ownership rights in your Status Submissions, but you have to have the rights in the first place.However, by submitting the Status Submissions to WhatsApp, you hereby grant WhatsApp a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Status Submissions in connection with the WhatsApp Service and WhatsApp’s (and its successor’s) business, including without limitation for promoting and redistributing part or all of the WhatsApp Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each subscriber to your status on the WhatsApp Service a non-exclusive license to access your Status Submissions through the Service. The foregoing license granted by you terminates once you remove or delete a Status Submission from the WhatsApp Service.

Dort heißt es, dass man die Rechte seiner Bilder an Whatsapp überträgt, richtig. Allerdings bezieht sich dies einzig und allein auf die STATUS-MELDUNGEN. Somit geht es keineswegs um jedes versendete Foto, so wie es in perfekter Bild-Manier propagiert wird.
Auf eine Richtigstellung in den Medien darf man sicher vergebens hoffen…
